Being part of the ACLU, they'd choose the illegal alien. Why? Because they have LESS rights in this country. And everyone in this country has the right to due process. The ACLU would choose the illegal because the Govt, cannot appoint him a lawyer. So 2 things could happen. He could be let go for not having a lawyer. Or the ACLU can work with him to try to prove he is innocent. The ACLU always looks out for the little guy. And the illegal probably has less money to afford a lawyer than the citizen. And, the ACLU is very liberal. Although I'm not.
Depends on whether the American is a male or female and if they are white or not. If a white male then defiantly they would go for helping the illegal.
Of course if the illegal was white and the American was not a white male they would have a problem deciding but they would probably still represent the illegal.
Of course I am a jerk and don't believe illegals deserve to be in our courts, they deserve no rights, if you know that you were attacked by any illegal and you know who that illegal is, I believe you should be allowed to punish him yourself. They have no right to due process.

It wouldn't matter if the US citizen was a homeless, blind, male or female, black or white or red or yellow, rich or poor, gay or straight, believer or atheist. There should be no trial if the perpetrator is an ILLEGAL ? He has no rights in this country ! The ACLU would represent which ever client would benefit them in making a mockery of the Justice System.
