I'm an american citizen and my husband isn't, so how can I help stay here in the US??
Answer:
My suggestion to you is to find a good immigration lawyer in your area to have help you with the paper work. The lawyer fee is expensive, but well worth it because there are so many forms that you have to fill out it's ridiculous. I know because I am going through it now.
One thing I can tell you is that if he entered illegally you're going to have a VERY HARD time, but if he entered legally, but is now illegal (For instance - overstaying a visa) it will be much better as long as you have the paper work to prove it.
he can apply for residency through you, don't worry nobdy will deport him, theres always people to help across the border
He can file for residency by virtue of being married to an American citizen.
Congratualations!!!
Well you can help him file for his permanent residency. The process can be lengthy but don't worry if he is here he wont get deported because you are already married. However he needs to file so he can legally work, and get the other perks of a legal resident.
Apply for a k-3 visa. You'll probably need to wait a while for his permission to work, so be prepared. The link will take you to the uscis (previously INS) website. You can download or order forms online. The process is expensive, and takes a while.
Is he here legally in the first place?
Don't expect an easy time if he's not.
Look you should find you a very good immigration attorney and let him advise you. He will tell you everything and will help you out. Please whatever you do, do it legally and the right way. Things will be so much easier for you in the long run.
Move to his nation and leave- we've got enough people here in the US and you'd be doing everyone a favor.
If you have to ask this quesiton, then you don't deserve american citizenship anyway
File the infamous form I-130. Good luck.
In order for him to get his residency you need to file for Adjustment of status you can find the procedure here http://www.visajourney.com/forums/index.... . Remember if he didnt get in the US with a fiancee visa (k1) you need to file an additional form called I130 .
