H4 to h1 while my husband is changing his job?
Answer:
You have to remember that H4 is a dependent of H1B. As you know a person can have more than one H1B. If he transfers his H1B to a new company and if the old company let USCIS know that he has moved on, that h1b will be cancelled and so does your H4. He should then have you listed as your H4 dependent on the new company's H1B so that you are in status until 10/1. Also you have to remember that if you have two applications (H1 & H4 in this case) pending with USCIS and the last approved case will be your status. That means if H4 is approved after H1, your status is H4 and not H1. You will need to re validate it by going out of the country and come back. This is a complex situation and you might want to get more suggestions on immigrationvoice.org, immigration.com and murthy.com
HTH
His H1B status does not affect your H1B, because H1Bs can only be based on employment, not on the status of anyone else.
His change of H1 employers has no bearing on your changing status from H4 to H1 unless he somehow loses H1 status prior to your H1 taking effect. You need to keep your H4 valid until the H1 goes into effect, and if he loses H1 status, you lose H4 status. Your 4/1 filing does nothing to keep you in status between 4/1 and 10/1, so be careful.
