i want to start a samll business but to do it legaly i need to use my SSN and mine says Not valid for employment, can i use it of do i have to get a Tax ID?? My legal staus is in process but i dont know how long is it going to take so i dont want to wait till is done to start my company.

You can apply for a small business tax ID (seperate from your personal tax ID "SSN") or set up an LLC for under $100 (not attached to your SSN) and be perfectly legal. The ONLY legal requirement is that you register the business and report the earnings and pay the appropriate taxes.
You "have" to wait, becasue if you do not wait and try to work around the law, you might lose yor status and its not wort it, so sit tight and wait.
