This can take quite awhile.As she over-stayed her Visa, she would receive a 3 to 10 year ban. However...you can petition for her by filing form l-130...heres what will happen though...it WILL be denied.once denied, you will then file form l-601 hardship waiver. In order to file the l-601, the petition l-130 must FIRST be denied. this is one of the reasons it can take so long. l-601 must be accompanied with the reasons for hardship.the problem for you is this...your not married...you need to marry her first to do any filing at all. So you have to go to Mexico and marry her first. this whole process may take over 18 months. Read up on the l-601 waiver, it can be found at the uscis website...I have also helped people do this as I work in an Attorneys office. Good luck you will need it as this can try your patience.
let her come here on a visit and marry her. then she is protected under your citizenship.
Apply for a fiance visa
If she overstayed a visa and was caught then she will not get another visa for 10 years from date of being caught. That is a law and the INS does not bend it.
go to mexico, find an american embassy down there or check with the loacal embassy where u r. wehn i married my now ex husband, all it took was a marriagecertificate and a visitorvisa for me, and then once we were in the US we had to apply for resident alien card.then maybe u can start the process of making her an american citizen if that is what she wants..good luck
I don't know about Mexico's laws but my son married a girl from eastern Europe about 3 years ago. She first came to the US for a 6 month visit on a fiance visa.She went back overseas.A year later my son went to her country and they were arried overseas. They went to the US embassy in her country to start the paperwork.I don't think it was more than a few hundred dollars.It took about one year for her to get all of her papers,green card work permit social security number.My son had returned to the states while she waited.Good luck, I would contact the US embassy in Mexico if I were you and ask some questions.

Have you married her? if not you can apply for a K1 visa. If you are not married. You can get married and then petition for her filing an I-130.
