I'm a US citizen but my husband is not legal help?

I've already submitted the paper work him to become a resident but we are scared that he will be asked to go back to MX if we submit the next step I've heard that families that have mentally ill children are even being asked to go back w/o the children what should I do.

He probably will not have to go back, you can apply for some type of relief and he will not need to return to Mexico.

Divorce that illegal and marry an American.Maybe you two could relocate in Mexico.Don't do it illegally,you will go to jail or be shot.

There's nothing you can do. He will be asked to go back to Mexico. That's for sure. He might be banned from returning for a few years as a penalty. Eventually he'll be here legally and you can get on with your lives. Make the best of it.

Why don't you go MX with him and if you want him to be USA citizens do so legally. They can't separate you and your children unless there is a reason of abuse or something like that.

Your husband is committing a third degree felony being here with out legal documentation. You are aiding abetting this behavior. You could be charged with a felony and your children removed from the home. Your husband should be deported and banned from returning for 10 years. Do what needs done to get legal. Do what you need to do to make him legal. Since he is married to you (a citizen), he probably has some benefits that he wouldn't be entitled to otherwise.

If you know any other illegals, encourage them to do the right thing if they love the U.S. and want to stay here.

They only make the people who are here illegally leave. As you are a US citizens you will not have to leave, if your child is a citizen then the child will not have to leave either, it will just be your husband. I know families in your situation state that it is a hardship and not fair to split up the families, but you knew this was a possibility when you got married. It is better to do it the right way and possibly be apart for a while during the process than to stay, get caught and be deported and not allowed to return at all. This is a very real risk you face if you do not do the paperwork legally.
Both of you go back to Mexico,when you married him you accepted him and his baggage so you belong in Mexico.

He has probably sworn allegiance to Mexico so it would do you good to be there with him and see what a wonderfull country they have.
It all depends if your husband entered illegally he might have to exit the U.S. and wait for his legal documents to enter and live in the U.S.
If he entered legally then I do not think that he has to exit the U.S.

Do you really want him to get legal status? You realize that if he does get status then (in 9 out of 10 cases) he will no longer need to be married to you and will divorce you.
Be careful, once legal he will have no further use for you. They use us U.S. legals to try and get legal. They will do anything and hurt anyone to fulfill their needs.
Look, if he goes back on his own and then returns legally it will be easy. He just has to stay south until the paperwork is done. If Immigration sends him back then he can't apply for status for a minimum of 5 years. Best to take a short-term separation.

As far as the children, when an illegal alien is sent back and the child is a US citizen then where the child goes is a decision for the parents. Immigration won't make a US citizen leave the country. The parent has the option of leaving the child in the care of a legal resident/citizen relative, the care of the state, or taking the child with them when they return. The parent is removable, not the US citizen child.
