The only salient fact is that they were born in the US. The citizenship (or legal status) of their parents does not matter.

Problem is are they really "tourists" or are they like the illegal alien criminals that pop out a kid so the kid is a citizen and then claim that they can't go back because of the kid's "rights."
Unfortunately, the law, but not the constitution has been interpreted that way for many years, but not always. Anyone born in the U.S.A. no matter their status are citizens. That has led to a big business for mid wives signing certificates along the border with Mexico so the children will be citizens.

Yes. Any Child born in any part of USA has a RIGHT to claim Citizenship. Most Countries have this rule. But this does not give scope for Parents to hitch hike on the Baby's right to become Citizens too!
Yes if they are born on American soil, then they are a American Citizens just as much as you and I., Anna Nicole Smith had her baby in the Bahama and she is a citizen of the Bahama's. I guess if she comes back to America which I hope she does I don't know if she will later in life have to take a citizenship test or not, probably will. Poor baby., I feel so sorry for that precious little baby. When she gets older will people harass her about all this that is going on and she can't help any of it.

The answer is yes. If a child is born on American soil, the baby is an American citizen.

Unfortunately yes and because of this many mexicans get pregnant cross the boarder and have the baby here and hope that just cause they have a kid here then they can stay but we need to change this law to a more updated version that if your parent have not yet apllied for their green card then you are not an american citizen and they need to leave with the parents
