What will happen to an international student after being caught for shoplifting as the first offender?
They took a picture of her and searched her all over, got her ID info, employment firm info, mailing address. They said there is no criminal record b/c no police got involved. We were shocked and went panic. What is going to happen next to her as an international student? She asked the score to give her something in writing proving that it is a confidental settlement after she paid the fine, but they did not but gave her a receipt. how shoud we believe this is a confidential settlement after the store got so much her info? thank you so much!
Answer:
She is free and clear for the shoplifting, but for the two-year ban on shopping there she probably signed the document agreeing not to enter the store for the next two years. If she is found in the store for any reason, she can be prosecuted for trespassing.
Since the PD did not get involved its fine. They took her information for their records in case she goes back into the store. She is lucky.
The best guarantee is that she never does that again.
Make a call to a lawyer's office. Many times the first consultation is free. Do not trust ordinary people's opinion about it. Make a phone call to a professional, maybe some has a lawyer friend.
Nothing to worry about at this time other than your cousin's lack of judgment.
In order to prove shoplifting, the People have to introduce the stolen goods into evidence. In this case, the goods would be precluded from evidentiary use because they were not reduced to the possession of the arresting officer at the earliest practicable time.
If your cousin were to be arrested now, the goods could not be introduced because the chain of custody is broken.
Nothing to worry about unless your cousin is foolish enough to shoplift again. Note that the big department stores share their files of shoplifters, so even if she goes to a store other than Saks to shoplift, they will know she's a repeater, and she will be arrested.
