Does anyone know the process of marrying an illegal immigrant in Cali?
Answer:
The legal status of the person you marry is of no consequence or barrier for you to marry him.
That being said, when you marry, you have to apply to adjust the status of the person based on being the spouse of a US citizen.
Provide the requested documentation from the adjustment of status application and you will likely have an interview to determine the legitimacy of your marriage.
You don't have to tell Social Security anything. The AOS application has a form to request work authorization. Once it is approved, he will be issued a social security number and work authorization.
Deportation is only an issue AFTER it has been proven that the marriage is fraudulent.
Good luck.
Meet in front of a taco stand?
Best way is to go with the illegal to Mexico, get married there, have the illegal go through all the legal process before coming back to US. That way, you can remain right by the side of your new spouse while the process takes place. You can contact SS when you return. Better than going through them years of questions and interviews.. ah... right.
the person who is illegal should leave, and apply for a work visa. Then when they come back the process of getting married should be easier. If you try to do it now then it might backfire in your face and then there would be a record of that person having been in the country illegally. It might be impossible to get them here after that. If they at least had a temporary legal status that would work in your favor.
Marrying is one thing, getting "papers" or a green card is another. I (U.S. citizen) am married to an illegal immigrant here in TX and that is the easy part. All we did is go down to the local government office and fill out the papers to get a marriage certificate (we just left out the part where we would put his social security #) and they sent us a pre-certificate (don't know what it is really called, but it is not the real thing until you are either married by the justice of the peace or by your own minister) that had to be signed by our minister when we had the formal wedding. And that is what we did, got married with all the family and friends, minister signed, we sent it back and then they sent us back the official marriage certificate.
As for the green card, I have looked into it in just about every possible way and it is impossible, even as his wife/husband, to get him/her a green card (permanent residency) if he/she crossed the border illegally. If he/she has a visa or an expired visa, you have a far better chance on petitioning for a green card. I haven't talked to a lawyer frankly because I am scared on how much it would cost, but there might be a way that way. However, the only way (I have done a lot of research into it) I do know for him/her to get a green card is for him/her to return to their country of origin and you petition for visa as his/her spouse. It would work that way.
You guys should speak to a lawyer before you contact the uscis to adjust the status. The illegal one probably will get deported or have to pay a fine.
Go to the courthouse and find out.
Great question...I don't know the answer but I saw a bunch of stupid answers from stupid people. Who said that you were marring a Mexican to begin with.it goes to show you the ignorance of Americans! Either way.I hope you find your answer!
BTW: my hat goes off to ken erestu
The INS (Illegal-immigrant Nuptials Service) used to handle this; contact Homeland Security to see who does this now. Just show up with your "fiance" and tell them who you are and what you want, and the rest will flow from there...
Why would someone want to? BTW, it's CALIFORNIA. It's NOT "Cali."
