How do you go about getting a work permit and/or a Social Security Number once you marry someone in the U.S.?

My girlfriend is from Scotland and I'm from the U.S. and we're looking to get married soon but we're wondering how to go about getting the work permit for her to work here or if she's automatically allowed to work legally. Does she need a permit or SSN? My County Clerk couldn't tell me anything. Just trying to map out this whole process.

Answer:
I would talk to an imigration lawyer if I were you. THe sooner you do the better cause in the long run it will save you a lot of time, money and stress.
I have a lot of friends who did that both with and without lawyers help and those who did it on their own did not enjoy the experience

First you need to make sure that she is here in some type of visa. Either a student visa or tourist visa and make sure that it has not EXPIRED. Once you are married, you need to file an I-130 for your wife. this is take somewhere around 90 days to be approved because you are a citizen and her husband. then she will be granted a Conditional Temporary Resident Card. Which has condition and is only good for 2 years. before that card expires you will need to Adjust her status to Permanment Resident by filing an I-485. This is also remove the Conditions of her Temporary Resident Card. It takes a few months to be filed and approved and then after the I-485 is approved there is a waiting time of 3 or 5 years before she can apply to become a US Citizen.
You can find all the papers at the USCIS website and a few others floating around the web. Another way to go is to get a lawyer but that only backs you up is something seriously goes wrong..

hope this helps. good luck
Where are you getting married?

If you get married in Scottland you'll have to come back alone, after you're married, and file form I-130 and all the supporting documents with the CIS. She'll get her immigrant visa in 6 to10 months.

If you want to get married in the USA you'll have to come back alone, unmarried, and file form I-129F and all the supporting documents with the CIS. She'll get her fiancee visa in 6 to 10 months. Once here you need to get married within 90 days.

After she gets here you'll need to file form I-765 for a Work Permit. This will allow her to work until her Green Card can be processed and come in the mail.

If she's here in the USA on a tourist visa and you get married, which you are not supposed to do, you file forms I-130, I-485 and I-765 all at the same time with the CIS. You'll get the Work Permit fairly fast and this will allow her to work until the Green Card comes in the mail.
