Can a naturalised british resident lose a british passport if they leave the country for more than 2 years?
Does anyone know if after doing all that, would she lose the passport or citizenship if she was to leave the country for more than 2 years?
Or can anyone advise where i might find the answer?
Thanks..
Answer:
Firstly she does not have to have ILR for 1 year before she can make the application for British citizenship. Pls refer to the British Nationality Act 1981, Schedule 1, Paragraph 3 c. On the date of application she must have ILR but this does not mean that she must hold it for at least 1 year, not under the 3 -year naturalisation rule (only for the 5- year one). I have done many applications for spouses and they did not have ILR for 1 year!!
Secondly, once she is naturalised as a British citizen she cannot loose this unless the Secretary of State revokes it. Only the ILR can be lost after an absence from the UK for more than 2 years.
Once a British citizen always a British citizen.
To enter the country I would presume she came in on an entry clearance visa which means she can stay for 2 years.
After the two years she would apply for her residency visa which would give her UNLIMITED leave to stay... she can only apply for citizenship I think it is after being a resident for 3 years (this part needs checking) So if your wife has a residency permit why is she worrying about losing her passport? You don't get a british passport until you are a citizen!
Have I confused you as much as what you are asking is confusing me?
First of all, you need to understand that she cannot apply for citizenship and the UK passport until she has had ILR for a year (as I understand it). ILR can be lost if the holder is absent for two years - and citizenship will not be granted if the applicant has spent more than 90 days in the last year away.
