His status will not change...If he came into the US illegally, there is only one way he can then change status. That way happens to have him return to his own country of origin first before you petition him. If he came into this country and OVER-STAYED his Visa, then thats a different matter. Thing is, he is ILLEGAL right now, and that issue should be addressed as soon as possible. good luck.
All these people are lieing. If he marries a citizen he becomes a permenent resident of the united states.
He will remain illegal until he is approved by INS. First he will have to fill out the proper applications. He will then have to leave this country for 6mo. or more because he entered illegally. The process is very time consuming and complicated. I would advise his fiance to start looking for an immigration attorney. This is what it takes for him to be a legal resident. After he becomes legal, he can work on citizenship.
P.S I'm honest,My husband was illegal when we were married 9 yrs ago. Laws tend to change for good reasons, for example-marring anyone just for status.
If he marries a US Citizen, he can apply for green card. Since he entered legally and if he can document it, he should be fine. See Yahoo rules for Answers forum about solicitation for your business (point being attorney can not solicit or help you directly).
If he can document that when he first came here, he came legally, with a visa, the US citizen spouse can submit a petition for him. He will be allowed to stay while it's being processed.
