US citizen marrying Chinese citizen, immigration?
He applied for a study visa several years ago and was turned down. I'm told it is very difficult for a Chinese citizen to get a US visa. ?
I'm wondering how hard it will be to get him a US visa if we're married. Does it take a long time? Anyone who has been there done that, please feel free to offer any advice. :)
Answer:
the best thing for you to do is consult with an immigration attorney they will be able to explain to you your options. I am going through the same thing right now with my girlfriend. for us I think it would be best to apply for the K1 visa that is also known as the fiance visa. if you marry in china it will still be very difficult for him to get a visa as your spouse because you will have to prove who they are. this web site will give you some info you will need http://beijing.usembassy-china.org.cn/in... but again consult an immigration attorney for the best answers. best of luck
If you get married in the United State it would be very easy.
You need to summit form I-129F to bring your fiancé(e) and that person's children to the United States for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000).
If you are filing for your fiance(e), file this petition at the Service Center with jurisdiction over your area of residence.
If you are filing for your fiance(e) and live outside the United States, submit this petition to the Service Center with jurisdiction over your last place of residence in the U.S.
If you are a U.S. citizen, and are using this form to bring in your wife or unmarried child under the LIFE Act, file this petition at:

Good luck to both of you
K1 fiance visa is possiblly the fastest way, and he has to marry with you in a couple months after he arrived USA, or his status will consider as illegal.
If you married with him, he can apply for US pernament resident (green card). From what I know, it takes a least half year.
Check our the US immigration website for the details.
