Two of my best friends live in Austria, and they both stay with me two months out of every year. Germany couldn't be all that much different.
She could be with your son, she just doesn't want to apparently.
That's not shocking. Why did she let it lapse in the first place? How did she come to the states in the first place?

Are you sure that she wants to come back to the US? Germany is a democratic country and I am sure they would not disallow a VISA if she really wanted one. 2-1/2 years is a long time to be denied a visa.
Has she ever heard of personal responsibility?

Be REALISTIC... and why doesn't your son go OVER there and see what's going on?

Bull! This is a plant to claim how hard it is to come here legally. If your story is true, then your daughter in law is an idiot. I have several German friends, and it is absolutely NOT difficult to come here.
Did she let her non immigrant visa expire in the US, then overstay on an expired visa for 6 months or more, and then leave for Germany?
In that case, she is out of luck. If one overstays by 6 months and then leaves voluntarily, they are barred from entering US for 3 years. In case of 1 year overstay, one is barred for 10 years.
She can enter US with a visa only after she is done with her time. Maybe an immigration attorney could have helped her if she didn't leave US soil and fought it here. Once she has left, it is extremely difficult to work around this law. The US consulate in Germany will not give her a visa before the time is done.
Can your son move to Germany? It must be difficult for him to be away from his wife and child. Or maybe both could move to Canada (not so far from US, and you could visit) or some other country for a few years until she can enter US.
Get a lawyer contact the American Embassy in Germany. Is you son in the military? If so he can take leave fly over with all the documentations (Marriage license birth certificates etc...)

Your story is missing something. Do you mean that she stayed over a year, and her green card expired? If so, she can apply for a new immigrant visa. If she was living in the US with nothing but a tourist visa or the Visa Waiver, then she has been denied for good reason: marriage by itself did not confer any new legal status on her. Your son must petition for immigrant status for his wife; if her immigrant visa has been denied because of a long illegal overstay in the US, they can request a waiver of her ineligibility by showing that he is suffering extreme hardship due to her absence. Surely an immigration lawyer has already explained all this to you.
