I'm a UK national and I'm going to be getting married in a few months. I'm going to be marrying my fiance' of 5 yrs. She's a commonwealth national, not a UK citizen. I've been living and working outside of the UK for the past 10 yrs in a commonwealth country, but I've been seriously considering going back to the UK with my new wife to re-settle. She studied in the UK and has returned there often both with and witout me. What i want to know is what would need to be done for her to go over there and live and work legally while i'm tying up loose ends here. Even preferably, having a home both here and in the UK and her having legal rights to both work and reside (in the UK) indefinitely. Her working in the UK would be better for her professionally both career wise and financially.
Answer:
She'll need a spouse visa to enter the UK WITH YOU (assuming you marry overseas). She won't be able to go ahead of you on such a visa - and seeing as SPOUSE is the correct visa category for your proposed future together in the UK I do not believe she'd have any luck in applying for any other category in the hope of coming ahead of you.
