The problem for you is that although the marriage is not recognized by federal law and can provide no immigration benefit, the fact that your partner is married to a Permanent Resident will be very problematic when he tries to enter on a B-2 (his intent must be to remain temporarily so if his relationship with you comes up, the consulate and/or CBP may not buy temporary intent).
