Help mother of my 8week old child might be deported?
my partner a south african followed me to the UK while my father was ill, since we have had a child. she is here on a holiday visa, she is a overstayer as the doctors advised here not to fly, we have this in writing. the child is register with the registra on both our names i am a uk citizen. we are know worried that she will be deported what will happen to the child? i am so affriad of loosing her and my baby. we have a life here. she does not work or cliam state funding. i am able to support them both. what can we do?
please please any avise.

If she has to leave the baby could go with her or stay with you as tit was born here in the UK.
immigration hear these storys every day, they dont care, if shes not legal then thats what the law is there for to protect the country from illegal aliens!! goe's to show immigration department works ocasionally

Sounds like it's time to get married. Junior is pretty good proof that you have been together a while. Not sure what UK requirements are.

You should have gone and applied to extend the visa. But now see a solicitor and get some advise. Because your child is born here it doesnt automatically mean it can stay here.
You will have to go to South Africa with her, she only had a holiday visa and now the holiday is over, as for the child it belongs with its mother and now both are capable of traveling so best really you stop worrying and just pack a bag and begin a new life in Africa, life is too short for complications so get on with it and make the most of what you've got instead of wanting what you can't have.
move to Africa or get her the papers to become a citizen.its not fair to all the other citizens for you to get a break.rules are for a purpose.you should have worn protection.or move if you really love them.man up-be responsible for once.plus get a better knowledge of the language your trying to write.find a solution do not all ways seek someones help MOVE!!!! im sorry but think next time.
This may be hard for you, but I would make arrangements for her to return to SA as soon as possible. She should then apply to rejoin you on a fiance visa. As you are a UK citizen and you say you can support and accommodate her, in principle the visa should be granted in a couple of months; you could then get married here, and in due course she could get settlement here.
The child can be registered as a UK citizen, so in theory the child could remain here with you, although I expect he/she would go with the mother. You can register the child as a South African national at South Africa house, this will not affect the child's claim to UK citizenship as dual nationality is allowed in the UK.
I strongly advise you to go togther to get legal advice asap; I do NOT recommend that you simply hang on hoping nothing bad will happen (it will eventually). It is not currently possible for you to get married in the UK, and in any case marriage would not alter the situation. If she is removed from the UK, she could still apply to rejoin you here, but her immigration history might go against her. On the other hand, if she leaves of her own free will, most likely there will be no record of her having overstayed.

Hi,I'm sorry you are worried,but there is noting you can do at this stage now,your partner is an over stayer,and that is bad.She is now out side the immigration law,the best thing right now is for her to return to SA and applied for a visa again,or you could get married in SA and applied for a spouse visa.Your partner wouldn't be deported unless she committed a serious crime,what will happen is that if you try and applied to the home office to renew her visa they will refuse her,and then issue an removal order to your partner to leave the country.If your partner went home and applied for a visitor visait would be difficult, they will say she can't be trusted,so get married.Am sorry for your situation but your partner did not follow the immigration rules.( the quicker she go home is the better,her chance of coming back).contact the law society for more help.

I think she might be able to stay i mean she doesnt claim any benifts. If she does get deported and if u really love her move to Africa its very cheap there.
1st of all, very unlikely you will loose the baby- the baby should be ok, as is a son/daughter/ of a GBR nat born in UK. As far as your partner is concerned, she may have to be removed to re apply for " partner's visa" and then come back. Or try to apply now for a visa in the H Office, whilst she is here. She can only be refused. Then you know what you are upagainst!
your only solution is for her to go to SA and apply for a fiance visa and come here to marry you or for you to go and marry her in SA then she can apply for spouse visa to live here or you can make a life in SA. Good luckkkkkkkkkk
She can apply for an extension while taking care of some papers to be an immigrant there if you are not married you should get married soon. I'm sure the govt. people there have a heart to understand you and your partner especially now that you already have a child from her. After all you are able to support them. Best Wishes. trust me on this one.the only solution and only way an immigrant can get granted a permanent visa, is to get married with an EU citizen.
Get a paper marriage, or a proper one, and her chances to stay forever will be 99%!
