I-20 problem, please help.?
My friend is international student has a problem with his status in US and i dont have enough information to help.
His I-20 has been terminated by his language school 1 month ago. Now he is applying a new school (university).
His university cant accept him cause his I-20 has been terminated. I suggest him to go out from US and come back.
The other side, he has applied an asylum last november but till now still dont know will be apporved / not.
Now, he is planning to travel out from US in this week and come back in 2 days later, such as mexico, by bus from LA.
Does he need a mexico visa from here ?
Can he come back to US later ?
i'm worry he cant come back to US, cause he applied an asylum.
Does he need to cancel his asylum first before go outside from US ?
Some people say, he can come back to US, but his asylum will be canceled. Now he doesnt care with his asylum will be canceled / not. He just want to go to school.
What you think ?
Answer:
I think he's trying to scam the system.
An I-20 is nothing more than a document supplied by the school that demonstrates that a person is enrolled in an accredited college, university or trade school. The student takes the I-20 to the US embassy, or any US consulate in his home country and applies for a student visa. It's up to the applicant to prove he/she can support him/herself in the US, pay for all his/her educational expenses and return home after finishing school.
It sounds like the person put in an asylum application in order to stay in the US. Many people do this even though they know they are not eligible. The reason they do it anyway is that it can take years and years and years to resolve an asylum application.
The fact that he's willing to return home to get a new student visa, even to drop the asylum claim, shows there's no fear of persecution as claimed in the asylum application.
If he goes to Mexico I hope he/she likes it because my guess is he won't be allowed back into the US.
