The question is, how did he enter the country? Did he over-stay his Visa? if so, then you will have to file l-130, l-485 and then a l-765 for work permit. then basically wait for further paperwork and interview.
If he crossed the border illegaly (without documentation) then he will have to go back to his country of origin and you will then have to file a l-130..however, it will be DENIED as he came into the US illegally...that is normal...after denial, and only after denial, you will have to file a l-601 (Application for Waiver of Ground of Excludability) which is another term for a hardship waiver. You will have to then write a letter explaining why it is a hardship. This method is NOT gauranteed. But if they do accept it, he will be able to enter the country to further do paperwork to get him legal and documented. Thats really about the only ways...any further answers can be found on www.uscis.gov, If you do nothing, you may risk further legal problems. If there are some other extenuationg circumstances, then also retain an attorney, especially when dealing with the hardship waiver.
You need to file the I-130 for him and then wait for the rest of the paperwork which will arrive in a step-by-step type manner. Go to www.uscis.gov for more information on that. If he's not legally in the country, he needs to return to his home country before you file. Also, continue working! You have to file an affidavit of support which means you have to have a job and make a set amount. Good luck! It will be several months before you can live together.
If he is in the US now...DO NOTHING
Doing the "right thing" at this point, is only going to get him deported.
This nonsense will be cleard up in early 09, but till then, make sure he keeps his nose clean and just wait it out.

in the UK you need to in form the home office you may be better of going to the citizens advise bureau they will help you with the forms but do it as soon as poss . buy things to gether and keep the receipt put gas , water ,electricity bills in both names .get photos of you to gether and with friends you will have to prove that you live to gether
