Look, don't blame non-Brits for your son's problems. I can't see from what you have said why he wouldn't qualify for JSA; I suggest you try the Citizens Advice Bureau for further help.

Just been reading up abot the Habitual Residence Test, which ironically is designed to limit access to benefits by non-Brits. It does appear that your son would have to establish that he was resident once again by living here for a period, but this should only be a few weeks - he should claim again at once. It seems that the regulations on the subject are unclear, the main point to establish is that he is intending to stay here, rather than just be visiting. It's a bit of a mess. Make a new claim tomarrow AM, and get down to the CAB. He should soon be on benefits (or hopefully working!!!!).

why on earth did he go to spain to find work in the 1st place if couldn't speak the language & then it took him a year in the sun to realise why he wasn't gettin any where
if he's wants a job that bad theres plenty out there
