Immigration Tribunal - what to expect?
She orignaly applied for an extention of her visit visa on the ground that it is unsafe for her to take the baby to uganda and this was rejected. We supported this application with a letter form our G.P, an email form the british high commission in Uganda and a copy of the FCO travel advise which states the the current measles problem in Uganda.
Has anyone got an idea of how much grilling we can expect from the home office lawyers?
Answer:
I think it is really quite difficult to get a visitor visa extended. It is unlikely that the Tribunal would consider the risk from measles to be so grave as to require your family to stay here; after all, millions of other people are expected to remain in Uganda, they would surely have rejected any claim to come here to escape measles.
Nevertheless, if you can produce both compelling medical evidence, and can convince the Tribunal that your family has full intention of returning when required, you might be lucky. A lot will depend on the Tribunal believing you or not. Answer everything absolutely honestly and fully. You need to demonstrate why the family members should be believed that they will return, for example because of their continuing ties there in the form of property, employment, family connections, etc. You obviously need to show how you will be able to continue supporting your family while they are here. I think it would be a good idea to be able to show what steps you are taking to have your baby immunised at the earliest opportunity. If you have already purchased return tickets, show that they will still be valid for travel at the end of the visa period requested. I would guess that you may also be asked about your own compliance with your visa, (unless you are a settled resident), and your long-term intentions to return to Africa or seek settlement here.
Frankly, even if they believe you, I wouldn't expect you to win such a case.
Depending on your status, you may be able to have them join you here on a spouse or dependant visa. for such an application to succeed, or for future visitor visas to be granted, it would be important that your wife does comply with the eventual decision of the Tribunal. Do not be tempted to overstay, it's not worht it!
The procedure in the Tribunal itself is relatively relaxed. No need to be intimidated, just speak the truth and hope for the best!
Good luck!
When u say "grilling" it makes me think you have something to hide. If u have nothing to hide then no matter what questions or amount of details they want you will be able to give them an answer easily.
Immigration is a hot potato with the British people right now so I would advise u choose your wording a bit better in future!
just go in and be honest with your answers and you won't have any trouble
