keep askin ins questions and they'll start looking for you
I don't understand your question. If you have applied for permanent residency what does that have to do with your job? Residency is not based on employment. Find another job and report your change to INS (homeland security) are you confusing a green card with a work visa?
Okay. It is my understanding that you can "Port" to a new company if your I-485 has been pending over 180 days. BUT the new company has to be offering you a similar job title, similar job discription, and same wage or higher as discribed in your certified labor certification. So start looking. Good luck.
The I-485 package is the application to register permanent residency or adjust status. They are many ways to adjust status. Since you mention that is work related and your I-140, Immigrant Petition for Alien Worker, I am going to assume that your employer has petition for you. It is good news that it has been approved. However, one of the conditions of he I-140 is that the employer shows evidence that you will be working for them, like a contract. Your employer also needs to summit an employment letter that confirms your work. The bad news is if the company closes you will not have a job. If this happens you will need to inform the CIS service. What you might want to do is to see if another company can file another petition for you.
Note: if the company is close and you lose your job with that company, you will be out of status. You will also be out of status if you work for another company, even if you have a visa and an I-94 to work in the U.S. You cannot work for another company, if you do and they find this out. Your visa will be cancelled, and you will be removed from the U.S. You won’t be able to file for a visa for 5 years. If another company is willing to hire you, asked them to petition for a workers visa for you. If you meet the requirements, they probably can file an I-485 and an I-140 package.
Good luck.
