Adoption? I have my British grandchild living with me, but cannot seem to get her through the US immigration.

I am a US resident, my husband is a citizen, my grandchild has lived with us for the past 4 years, both parents of the child do not want this child. I have been trying to get lawyers to help me with this, so that she can become a legal resident; but four years on -no one has been able to help. This child needs a social security number, needs health insurance, needs to be recognized and a child in the USA with rights, and needs to go through immigration but INS needs an adoption cert, which I can not get either here or in England, what can I do? There has to be a way forward. This child is an exceptional 'A' student and wants to have a life like the rest of our family. We have used all our savings on lawyers and health care for this child and still no further forward! The child is still and illegal immigrant unable to travel outside the USA for fear of not being allowed back. Please is there any person that can help. Thank you.

Answer:
You are to be warmly commended for caring for your grandchild. Thank you for giving him or her a home.

I presume from your careful wording that this child is your grandchild only, rather than a blood relative of your husband. If the child is your husband's own grandchild, there is a special category of citizenship available. If, however, the child has no claim to US citizenship from your husband and if the child's parents won't cooperate with adoption, there is no legal immigration category into which your relationship fits easily. But there are still possibilities that your lawyers might not have considered such as special immigrant status, especially if the child is under 18.

I strongly suggest that you hire an excellent immigration attorney (there are plenty of poor ones, as you seem to have already discovered), If you want a recommendation, email me. If you would like to discuss the case further, let me know and we can do it offline.
This is what irritates me the most about immigration.People like you who try to do things the right way,get screwed. Those who jump the border get everything handed to them.
I wish I had an answer for you.Perhaps if your husband is a citizen,it might be easier for him to start the adoption process? Can you get the parents to agree to this?
I really wish I knew what to tell you,but the laws are so messed up.All I can say is good luck, this child deserves a chance.
Thats because your doing it the legal way. If your doind it properly the government is going to give oyu crap about it, if not they say oh well, we dont feel like doing our job.
Become Angelina Jolie. I think it is so unfair that at any point in time she can go to some poor country and adopt a kid and bring it to US in the same week. Is she the only one who pays taxes and why cant they give the same considerations to us regular people?
I guess you can have Angelina adopt the child and probably sign over custody to you!
