Can citizens make arrest base on there legal or illegal status alone?

you can only be a witness, you have no right or authority to arrest someone, or they could easily press charges against you. even if they were robbing a bank and you tried to arrest them, they could most likely sue you and win with the way people twist stuff in court these days
Yes. That is called a citizens arrest. You must annouce that you are making a citizens arrest when doing one. However you cannot detain them by using force. Have a cell phone, contact the PD, and follow them (if they flee) instead while advising PD where you are at all times, and where they are. Have done this a few times myself.
