K1 Visa Question?
Answer:
What you are asking about is what we in the visa business call "dual intent." That is, you intend to immigrate in the future, but at this time you are making only a short tourist visit. Yes, you may do that. People in your situation do it all the time.
You may legally enter the US on the Visa Waiver. When you arrive, tell the CBP officer the truth. (You might even get extra points if you use the term "dual intent.") You are doing nothing wrong or illegal as long as your intentions are as you have described, and you will be admitted.
no it isnt. You must remain out of the country until you get approval for the K-1. If you try to enter while the K-1 is pending, USCIS will have you red-flagged as a potential problem as the visa you have is only for visiting purposes. Why not have your fiancee come visit you instead? Sorry...
Even if you could get a tourist visa it takes about 3 months to process, the problem is that you are a single female and you are considered a flight risk and would be denied a tourist visa, second thing would be you would make problems with the K1 visa as your name is already in the Data base for the K1 and when you name is re-entered for a tourist visa it would be red flagged. Have him come visit and don't spoil the K1 that is already in progress. I wish you both the very best in your new upcoming marriage
If you do this you reset the timer back to 6 months.
