Who can own property in the US? If an over-stayer buys property, is it seized upon deportation?
Answer:
No. You don't have to be a citizen to own property in this country. The government has no right to take it just because your here illegally.
Not unless it was used for a crime, like a meth lab or a safe house, generally.
Foreigners buy here and rent out without even living here, often.
As far as I know, they cannot seized that property, unless they are involved with drug trafficking, the RICO law was written for this. But a violator of immigration law is a misdemeanor and they cannot seize property for that.
the government will not seize property however they should since it is bought with money obtained illegally. I know some will argue this but if someone isn't legal to work here, then the money they made is illegal too
Anyone can buy property, and will continue to own it even if deported. Property can be seized if it used for unlawful purposes, but merely living on it isn't, even if one is in the US illegally.
