Can you leave the country if you are in the process of obtaining a greencard?

my husband, as of december 12, 2006, is in the process of getting his greencard(just started) and we have a wedding for his brother in Ireland and its in August! We dont thin he will have the greencard by then...will they let him obtain a waiver?

First off, the Green Card proccesing times have gone way down, so I really think that your husband will have the green card by then. Otherwise, he needs to apply for a travel document ( the paperwork is in the green card application papers check DHS website) It cost I think $120 and it take 1-3 months for it to be proccesed. HE can leave the country with that document no problem. Do not attempt to leave the country without a travel document, it can cause issues with his application and DHS may see his leaving as abandonment of the application for Green Card..
I Need a little more infomation, how did he come to this country, which visa, (k1, etc...) has he done AOS yet?
You can leave, but dont count on getting back in for at least 10 years.

You can get a waiver. When I applied for my green card, my immigration attorney applied for a travel waiver for aliens to allow me to go home to England during the process. If you travel without one, you have to reapply for your green card and start all over again.

You can use I-131 to request permission to travel while the green card is pending. It's sometimes called "Advanced Parole". USCIS has the form on their website.
I wouldn't recommend leaving the country without the green card, However if the legal status is pending he should require his passport to be stamped by the INS services allowing for a return entry to the territory. Note: if you take a lawyer for your process it will go faster. good luck.

File I-131 asap and generally you will get it in 30-45 days. If you had filed through a lawyer ask him if he has already filed it when he filed for the GC.
It all depends on what status he is using to get his green card. Some allow you to leave and some do not, and if he is not allowed to leave and does, he will only be deporting himself??? So you need to check to see under what status, and or if he can get permission???
