ART. 26 OF FAMILY CODE APPLIES TO THE EXTENT THAT, ONLY THOSE MARRIAGES WHERE ONE OR BOTH OF THE CONTRACTING PARTIES IS/ARE ALIEN AT THE TIME OF THE CELEBRATION OF THE MARRIAGE. IF FOREIGN CITIZENSHIP WAS OBTAINED ONLY AFTER THE CELEBRATION OF THE MARRIAGE, THE DIVORCE OBTAINED THEREAFTER WILL NOT BENEFIT THE OTHER SPOUSE. THAT MEANS, AFTER THE GRANT OF FOREIGN CITIZENSHIP AND AFTER THE GRANT OF DIVORCE FILED BY THE NOW-FOREIGN SPOUSE, THE NOW-FOREIGN SPOUSE WILL BE LEGALLY FREE TO RE-MARRY. HOWEVER, THE REMAINING FILIPINO SPOUSE WONT BE ABLE TO RE-MARRY WITHOUT HIS/HER MARRIAGE ANNULLED IN THE PHILIPPINES. THIS SEEMS TO BE UNFAIR, BUT THIS IS THE INTERPRETATION OF THE LAW.

well the problem you have is kinda complicated coz, i believe that in the philippines they do not believe in divorce, so it would be hard in your case unless, your husband passed away.
go back to flipina with ur husband get divorced in filipina and come to america and if u find ur boyfriend still around u can marry him dont waste american taxpayers money by going to american courts ok

well getting a divorce in your country is not permitted right? but getting a divorce here it is legal. so yeah you can get a divorce in the u.s but i believe your husband has to be present at that moment because you both has to sign a paper work. is your husband here in the u.s?
your marriage has nothing to do with United States.
plus you have to serve your husband divorce paper, he need to sign them and travel to USA for the divorce hearing?

Probably, especially if you are in a state which allows no-fault divorce (which, these days, is a lot of them). Perhaps the biggest problem will be serving papers on your ex-to-be.
you need to wait for your marriage to annulled before you can marry again otherwise your second marriage is just nothing.and beside you need a strong grounds for your husband to get your marriage to be annulled otherwise the court will not grant it...and you need to do that in the Philippines..

Are you a citizen of the Phillipines still?
If so, than you need to get an attorney from there and check on a foreign divorce. I'm sure like the U.S, the Phillipines will not accept divorces from some other countries. You may have to divorce in your country. If you are no longer a citizen a U.S divorce will do you just fine.
