Answer:
I'm not an attorney, but have been through the process and know a lot of others who have also been through the process of getting permanant residency for their spouse. You would have to go into a bit more detail to get a good answer. If she has only entered that one time, then she would be eligible to file a waiver and if that is approved, she would get her permanant residency. She will have to leave the country and go to an interview in the country where she was born... if that is Mexico, she will go to Ciudad Juarez, across the border from El Paso, TX and will have her interview there. If she has her interview there, they have a new program called the pilot program, and she may (depending on your case's specifics) only be out of the country for a couple of weeks. If the case is complicated or if she has any type of criminal record, she could be out of the country for a year or more... Please go to the weblink and post your question at that forum, you will find great answers, and be able to tell your story to others going through the same thing. There is also an immigration attorney that has a free chat every Wednesday, and you can ask her questions, too at the chat... She does come to the site often, also. I hope that helps.
