You have to apply for a visa with your new spouse. The death clause would only apply after the adjustment of status takes effect.
You commited marriage fraud in the eyes of immigration...why didnt you go back to your country when you had the chance? Now your screwed...
onehello67- Not true.the K-1 was meant for the original petitioner, he married someone else.he cant re-apply now...USCIS will have the K-1 on record...he's toast..

- Hmmm, sounds like you were pretty much in control of this whole operation. The fact that you knew full well that it is illegal to marry someone other than the person who filed the petition for you, and then went on to make the necessary arrangement with someone who just happened to "like" you and married you before the expiration date on your K-1 visa tells us that you are a low-life fraud. Unfortunately the US immigration laws/policies are so easy to manipulate that I'm sure the only price you (or your "wife") would have to pay would be the lawyer's fees. Sigh. Like someone said "go home", but alas, I don't think that's going to happen. Say, maybe you can be one of the 12 - 20 million illegals who are "living in the shadows ..."
What kind of person is your "wife" that she couldn't see you for what you are? Does she even know the full story? Or did some good ol' greenback exchange hands for a Green Card?
As far as I can see, the only good thing that has transpired is that the person who filed the petition for you has passed away - she'll NEVER have to live with a person like you!
