as to his citizenship, i cant say, but as for the american, if the marriage is fraudulent, solely to allow an alien to enter the united states, both the citizen and the alien can be prosecuted by federal authorities and subject to 5 years imprisonment in a federal penitentiary. The proofs are seen of such fraud by what the persons do after they marry - go their separate ways and never live much together. Thats indicative of fraud
