My Aussie partner overstayed his US visa but didn't get caught (left voluntarily) Can he get back in the US?

We are planning on getting married this November in AU (we live here now...I am an American citizen and a legal permanent resident as his de facto spouse here in AU) but need to go back to CA, US for a friends wedding next June.do we need to apply for a visitors visa for him? Do we need to fill out any special forms because he overstayed? We just don't want to buy plane tickets, get there and then have them refuse him entry to the country? Would it be better to apply for a green card after our marriage in Nov? Help! Thanks!

My son girlfriend overstayed her visa too about 4 years ago. They punished her by not giving her a visa again.He went to her country abd married her so she could come back.P.S. It took about one year after they were married for her to get a green card.
