F-1 out of status. How long should I stay in the country before facing deportation and the 3-10yr bar?

F-1 fallen out of status because of failure to maintain full course load at a university. I wanted to reinstate but it stated that USCIS will only approve if there is prove of "extreme hardship." what is the exact meaning of that? If I don't get reinstated, how long can i stay in the U.S before facing deportation or the 3-10 year bar if I want to go back? I heard that some people was out of status for years n never received notification from INS?

Answer:
"Extreme Hardship" meaning circumstances beyond your control- unexpected or unforeseen.

If you stay here out of status for 6 months and up to 1 year, you Will be subject to 3 year bar.

If you stay here out of status for one year upwards, you will be subject to 10 year bar.

Bars apply only if you are out of the country and are trying to get immigrant visa.

As far as receiving notification from INS is concerned, one never knows when they will issue. It is a manpower and resources issue for them.

But you know the truth, do the right thing!!
