Will an arrest affect getting a Green Card?

My wife was recently arrested for domestic violence against me. The judge dropped all charges, but there is still an arrest on her record. Will this affect her chances of getting a green card or a job? She is currently a F-1 student and had no pior convictions or arrests. I am also planning to file to seal and expuge her record. Thanks!

The arrest will definitely "affect" her green card application, but it alone should not be the reason for denial of her case. It is almost certain that she will be requested to go to an interview, so make sure you have all court documents ready. Note that she must answer Yes to the question whether she has been arrested before on form i-485, regardless of whether the charge was dropped or if you can get her arrest record expunged. I'd recommend you consult an immigration attorney for this matter; arrests in 485 applications may be no big deal in many cases, but can get complicated if not handled correctly.

You can file to have the record expunged and sealed but It will still show up as a sealed record. That is sure to raise some suspicions.

1. you cannot seal AND expunge a record. Sealing it means that it legally exists, but that noone is legally allowed to know the contents of the record. expuged is erasing it completely.
The problems you will encounter is that she was supposed to file for change in status PRIOR to getting married. Immigration looks down upon applicants that did not follow procedure. and she cannot plead ignorance, as she had to sign papers showing that she both understood and accepted the limitations placed upon her for her student visa
You will probably need an attorney for this case, unless you get a VERY nice, understanding immigration worker.
