First, has to be proved. If it is just an assumption then that's racial profiling.
It depends on who stops you. If it's border patrol, they might think you're smuggling them in here. I'm serious, If you go through one of their stop points and they find that there was an illegal in the car with you, they might arrest you for smuggling until you can prove you had no idea.

If you are legally entitled to be the US, and have proper id, you have no have chance of going to jail unless you insist you knew he/she was illegal.

Your illegal alien friend is probably not going to jail either because corralling one person is not exactly a big bust and therefore not very cost effective.

No, I don't think so. Unless you were doing something like TRANSPORTING the illegal between cities or states, or taking them someplace to get some sort of fake green cards, etc.
