A Non-Citizen Divorce............Troubl... or Not?
I do have a Conditional Permanent Resident Greencard,and have been had that status since (05/19/2004).
My husband is American,and we have been married for 5yrs.
I've been wanting to get a divorce from him for a long time,but are very worried of where that would leave me,since I'm not yet a citizen. Do I have to go back to Europe? I don't have no children and we doesn't share any property,my husband is lazy and doesn't wanna work.
We have been separated (not legally) for the reasons above,
I'm doing my best to make it on my own,it has been very hard at times,but I am hanging in there because I'm a positive person.
The FEW times that I've asked my husband for a little financial help ($100)or even just($60),he's trying trying to make it look like I am the problem (in the reality he knows that he doesn't own any money and are embarresed to achknowlege that. He doesn't even make a EFFORT to help me. How much will a divorce cost.Does he pay?

Did you and your husband file Form I-751, to remove your conditional status? That needed to have been done within 90 days preceding the second anniversary of your receiving conditional permanent resident status. If not, then you are accruing unlawful presence in the United States from that two year anniversary date and are subject to arrest and removal. Although there are some exceptions, based on the fact that you indicated you have not divorced simply to retain US immigrant status, it is unlikely that you would prevail. if you got your residency on 5/19/04 then your status is expired, did you file to remove the conditions yet?
I think your situation is complex enough- go see a lawyer for advice
After 2 years of obtaining the conditional residency, you have to file to remove the conditional residency or you will be one more illegal in the country. You don't have much time File, you will need money though.
