Immigration papers?
Answer:
he has to follow the rules like everyone else.
It doesn't make a difference that he was brought here as a baby, if he wasn't born here, then he's illegal and if he's caught, he will be deported.
Follow the Law, if he got here as a baby, his paper work, will have been in the system for a long time.
No sweetie .. unfortunately not.. I am in the exact same place.. we're married already. I'm going to be going to a lawyer soon - just to make sure.. I'll let you know if I hear anything. Email me bj_osterhout@yahoo.com
There is nothing to do but wait.. terrible I know. Tell him to make sure he goes to college, that way if the Dream Act passes he can become legal that way (it's a bill just for people like him and my husband that came as babies and are now students in college) hopefully it will pass soon.. If not it could be 2009/2010 before anything happens.
BUT btw if he somehow had a Visa (which I doubt) or if someone filed a petition for him before 2001 then yes you can help him through your marriage. Ask him about the petition and be sure to ask his parents too. My husband's parents filed one for him but unfortunately the "lawyer" disapeared and was never heard from again.
BTW he should be ok not to get deported.. I am not sure but I think they won't deport him if he's married.. But they aren't doing many deportations these days anyway. Some judges will deport so tell him to be extra careful - no little crimes like DUI or driving with no license or drugs or stupid little things like that could be devestating for you guys.
