visa waiver I-94W question ( moral turpitude ) have you ever been arrested or convicted !
I was arrested 3 years ago on suspition of theft but was not convicted should I answer yes or no, how would immigration know ?

Usually they mean a felony... I would say no
Tell the truth because they know everything. If there is any space for you to provide more information on the form as to why you were arrested I recommend to briefly explain what happened.
The safe answer is to declare it as a crime of dishonesty is considered moral turpitude. This is especially true if you can show it was minor and that you were never convicted. Can you get anything in writing.
The not-so-safe answer is that, as it was (presumably) minor and you were not actually convicted, you might choose to ignore it.
My view is that you should always be completely honest with US Immigration. They have a lot of information at their fingertips and most of them are consummate professionals who do not want to cause trouble for someone who is unlikely to cause any threat to the USA, moral or otherwise.

I am a Brit from Manchester and have been though this with a friend of mine, never ever tell anyone about your past even in the same country, other countries, contrarary to popular belief do not have any access, whatsoever to your UK criminal history.
Keep quiet or I promise you that you will suffer a lot of unnecccesary grief. The Daily Mail did a report on this around 2 years ago, they quoted confidentiality of information act in their analysis.
My friends are criminals they never told them and have never been asked about it, they have been in and out many times with no problem. Some of them have lived there years and still come in and out with no problem, they keep quiet.
Do not tell them as you will suffer, beleive me.
