U.S. citizen w/ illegal wife, have 1 kid, whats the best way to get her fixed?

I heard that if we get married we can apply, but she would have to go to Mexico and wait to get an evetual permition to get in the country
is that true or may be would it be easer if I go to Mexico and married her there?
would that make a difference?
would it be quicker?
any other ideas to fix my wife in the less possible time would be appreciated

Your wife would kill you if she knew you were referring to her as if she needs to get "fixed" I'd check out uscis website for info that would lead you in the direction you need to take.
One sentence indicates you are married,,,, the next says 'if we get married. She is illegal. Yes, go back to Mexico with her.
You would have to take her to the doctor to get her fixed, but I think they call it something different when you do it for humans than when you do it for pets.

The best way to get her fixed is to take her to the vet. I would prefer one in mejico. Better stay there to incase of complications.
Fake marriage certificate showing that you have been married longer than you have, then apply for citizenship with the INS. It's a bit unethical but it works.
Since you are already married, you cant get married twice - so that option is out. The new immigration bill implies that she has to return to Mexico. However you should start the "filing" process with immigration for her to get a green card or citizenship. Th eprocess is usually very long. I know u propbably fear that she might get deported but her status needs to get fixed now or in the near future.
if she crossed the border illegally then immigration will probably turn you down because they cant adjust her status because she never got inspected.

Petey is right.if she came over undocumented (without Visa) She cannot adjust status. If she crosses back to Mexico, USCIS will slap a automatic 3 to 10 year ban on her.the first thing you need to do is be married to her...once she is back in Mexico, you will then file a l-130 petition for her...it WILL be denied due to her crossing Illegally and the subsequent ban...therefore, you will then file l-601 (Application for Waiver of Ground of Excludability). Be advised, she will have to go Ciudad for this process. You will have to write an explanation of what the Hardship is. Having a child by her will definately help. This is the ONLY way you can get her legal now due to her Illegal crossing into the US. The cost for the filing is 265.00...but bet on more for other expenses. Get her tubes tied? That's what you are implying by "getting her fixed". She's ILLEGAL you can't "fix her" on this side of the border!

You can fix her by getting her to get her tubes tied, birth control is also an option as well.
Take her to the doctor and tell him you want her to have a tubal ligation.
I agree with outrageous5, that's the same information I have been given by different immigration attorneys.

There is one more thing I would like to comment though... by experience I can tell you that it is a tough situation but be patient. Do get married if you haven't done it yet because that's going to be required for you to be able to help her in the future.
Your kid will definitely be a plus, make sure she stays away from trouble ( no criminal record) and she learns English.

My suggestion for your situation would be to stay in the country. I was told by an attorney that if you stay for a good period of time and keep a clean record, you can go before an immigration judge and with more positive things on your side than negatives you are most likely to win your case and she will get a work permit, work her way up to a greencard and eventually citizenship. It will take time and some cash as well as lots of patience but I think it is a small price to pay considering the fact that she broke the law.
