If he never filed for divorce from his first wife, then no, her marriage to this man was not legal. She should check with an attorney about her legal rights in this common law marriage that may have not been a marriage at all.
I would contact the coroners office in the county he died in.

Ok this is what happen to a lady I known, she was a mistress of a merry man, is about that same as not been merry and live with somebody, she have two kids. After this gentleman die in a car accident, she when to a Law firm, they did a DNA check on her kids, got letter from people who knows then as a couple, rent receives on his name, joint checking account, every thing to show they where living together. She got part of his check but that most important her kids got money until they turn 18. After some years living with someone they create responsibilities and privileges even if they weren’t marry. Check with a lawyer.
