Unfortunately, yes they can deport him. He is an overstayer, the fact of having kids here will cut no ice with Immigration. They will say that you can go and live with him in his country; alternatively, he can apply to come back as a fiance/spouse (not sure which, as I guess that your marriage has no legal status if it was not registered). However there could be difficulties getting such a visa, given his immigration history.
You need to contact an immigration solicitor immediately. Although a claim for asylum would be considered opportunistic, it may nevertheless prevent removal. This should be a last resort. Which country is he from? Does he have a date for removal set yet?
In the end, it is likely that he will be sent back. Are you prepared to live with him over there? It could be a major culture shock, but the kids would grow up with two cultures; and there would still be the possibility of returning in due course. I don't know for sure, but I guess that the authorities would be more likely to grant him a visa to return in such circumstances.

Yes they can since you are not married to him legally,what you can do is get a good lawyer who know his stuff on immigration law and i think you and your family will be fine,but do get married to him legally later,good luck

Unfortunately I think they can even though you are married. The kids can stay, but he may have to go. Had you have done this properly, this would not have happened.
They did it to a local guy last year. He had to go back home and then apply properly for a visa on the grounds that he had married a bride with an English passport. I don't think it matters which religion the marriage followed - so long as you have a marriage certificate.

I think so. After all, he is not British and the family need not be split as you and the children could leave with him. A friend married someone from Turkey, and he had to leave and fight an appeal from there even though they are legally married, although no children are involved. It's taking ages.
British law recognises all 'living together' relationships as the same, whether they are a Christian marriage, Islam marriage, civil union, defacto, same sex etc. Your partner would have been entitled to residency when you started living together, but as you did not do it then, they can deport him now. If, after he is deported, he goes through the correct channels he will probably be allowed to come back though.

And yes, if HO records show that, at the time of the arrest he was here illegally, he may be removed. However, he can apply for a visa - and come back.
