my friend has applied for a naturalization based on her marriage to a citizen. she was married in 2001 and has a green card. the last two years have been tough on them and he moved out with two separate girlfriends, returning home briefly after each fling. during this time they both filed taxes separately as head of household. then he came back and they were together again, so she filed for citizenship. ofcourse again he decided to leave her high and dry and has moved in with a new girl.
my question is ...will immigration ask my friend about her taxes ? will they wonder why they have not filed joint ?
Answer:
All your friend will have to say is that they deemed it more beneficial for them to file that way. The INS has no right to decide how taxes are filed, or why they are filed in a specific manner. But, she should try to be as convincing as possible.
ps she may want to make sure her husband goes along with it.
