Best, quickest way for citizenship??

My husband is 29, he has been in this country since he was 8, we are legally married for 4 years now, we have a baby on the way in 2 mos., his mom brought him here illegally, but she is a permanent resident alien, and filed way back when for the I-130 (petition to make him legal).. I don't know what ever happened with that.. but at one point he had his work authorization card and let that expire. He has a valid social security card and driver license, and has been paying and receiving his taxes for years.

My question is.. what is the quickest way for us to get him citizenship.. through me and our son or through his mother?
What do we have to do now? Am I able to apply for his citizenship?

As the person before me said, it makes no sense. If he was a minor and his mom was a LPR (legal permanent resident) then why didn't he get green card along with her? It doesn't matter if she got it through marriage or work, as a minor he could have benefited along with her. Another thing is how did he come here illegally? like it was written above, he most likely came on a B-2 (tourist) visa and overstayed. How old was he when his mother petitoned for him? was he married yet or single? those things put him in different categories and the wait time to adjust status changes as visas are available quicker to one category than the other. His priority date from that I-130 filed might be now avaialable so maybe check the receipt number on the USCIS website (if you still have the receipt number, if not maybe file a FOIA with USCIS to see what documents they have on this case, if it was closed, they will have a letter explaining why it was closed- FOIA takes a long time though). If he did somehow cross the border without inspection, as long as he had something filed before April 30, 2001 then you should be ok to file. It's always best to speak to an Immigration lawyer in such cases
First of all, that was really stupid to let his work authorization card expire, however he should have received a permanent status card before that ran out. My best advice is go find an immigration lawyer and explain your cituation to him/her.
I think that the quickest way to citizenship would be through you and your son.

The facts that you laid out dont make sense...if his mom and he entered the US illegally, he wouldnt be able to adjust status...so what I think happened was that they entered legally, but over-stayed...if that indeed happened, then all you should have to do is file a I-130, I-485, and a I-765 as the petitioner to adjust staus. Anyone who enters the US thru Illegal means cannot adjust status as they are undocumented. Anyone who enters the US legally is documented. If there are any questions of concern, then contact an Atty for a consultation especially if any facts are in question. The quickest way to adjust would be thru you the spouse though.
