Legal question about marriage and visas here in America.?

My fiance is here in America on a legal work visa. After we are married with marriage license papers, can he legally leave where his work visa is intended? Also, how long does it take for the adjust status papers to be legal? My fiance only wants marriage for him and I, not to be a citizen.

You'll have to petition for an I-130 and probably the employment authorization as well - since once his status changes, he won't be able to rely on his work visa any longer.
You should contact the department of state for the average turn around time. Hopefully he is marrying you for the right reasons.

The work visa is between him and his employer. Your marriage would have nothing to do with the status of his visa. But once you are married and you are a U.S. citizen, he can apply for conditional permanent residency which is a different type of visa. He has to prove for 2 years that he is really married to you. The process to get conditional residency can take 7 months for the paper work and over $400 dollars. After that process, he can apply for permenent residency with more paper work and fees. He can't leave his job. If he has a work visa, then he must continue work at the current job in order for the work visa to be valid. When you get married, you can petition to get him a work authorization card but this takes a few months. I recommend that he stay at the current job until you get the work authorization card. Once he gets the work authorization card, he can look for another job. Marriage takes a lot of time, figure waiting at least a year for the interview. But work authorization cards are usually given out within a few months of filing.

Another thing, once he files for adjustment of status based on marriage he will not be allowed to leave the country. If he still has a valid work visa, then he can leave and come back. So if you plan on traveling, such as your honeymoon, he should stick with the current job and hold onto the work visa.

If he has an H visa, it is possible for him to self-petition for a green card, without having to go through marriage. I think after 2 years, but before 3rd year is up, he can sponsor himself for a green card.
