Can Native Canadians live and work in the US without a Green Card?
Answer:
YES! My BF moved down here 10/06 and he lives here as an American Citizen.
1) Make sure he has 2 passport photo's of himself.
2) Make sure he has his blood quantum letter (Letter from band office proving 50% or more, Native Blood status).
3) A Passport will now be required (if I recall the date correctly) for him to enter the US.
4) He will need his Original or Certified copy of his Birth Certificate.
5) He will need his Status Card
Now, just so you and he both know.. The Customs office MAY TRY to give him a I-551 card (Green Card) on the spot. Do not allow them to do this, as this is in conflict with the Jay Treaty. My BF made this mistake, and it took SS a long time to clean it up. This is LAW, according to treaty. They have not revised this treaty, altho Dept of Homeland Security thinks it is it's own country now LOL
My BF took his Green Card to SS and they said No that was done wrong. They issued him a new SS# and with that he was able to get his drivers license. He is able to apply for and receive a US Passport. Any questions hun, you email me again :) Good Luck to you 2!!! We are doing GREAT! :)
11 millions mexicans are doing it, I don't see why a Canadian can't do it.
Yes. As long as he is 50% or more. This is the legacy of the Jay Treaty of 1794 and codifed at INA 289.
