Even if you marry him he will have to return to Mexico and wait for a visa to come back to the USA.This usually takes about 9 months.The prior arrest may or may not affect him,I'm not sure.You should consult an attorney regarding this.

Just by marrying an American citizen does not give a non-citizen (here legally or otherwise) the right to stay in the country.
My brother, a lawyer, married a girl who came here legally and stayed after her visa expired. He started very early to correct her status so she wouldn't be deported. I do not remember if everything was settled by the day of the wedding. It was almost 10 years ago and the marriage didn't make it.
If you really loved him and he really loved you, he will take you back to Mexico (or whatever country he is from) and you would go.
If he will not go or you will not go, then love is not involved.

he has already broken one law being here illegal, that's enough for deportation right there. You can marry him then he can file the proper paperwork FROM his own country, which looks better than being here illegally and then filing for them, he may have a better chance.
