First step GO HOME. DON'T CUT IN LINE of the decent people who are trying to become residents legally, then wait like everyone else.
Sorry to inform you, but you cannot file, or you will be deported.You have to be here legally, like with a tourist visa.
It will be big fun as it is tough enough to marry outside the country and bring someone in. You will hear,often that you need to go home and reapply from there even if you married in the US. And heres the thing.. at any point years later and with paper.. he can bump you so fast in a divorce it will not even be funny. The only real way again, go home and have him get you here legally.. then you will have rights.
Go back to your country. If you file now you get deported and can not come back for ten years, married or not.

If you marry him here and file the I-130!? you will end up filing a I-601 waiver and you will have to wait it out in your home Country.

I am all for immigration but completely against criminals!What makes you think you have the right to stay in the United States? You obviously have zero respect for our laws and our country. You are a criminal and should be deported and if your husband knows that your illegal then he should be charged with aiding and abetting a criminal. It is time for Americans to stand up for what is right and defend our country against your type. You drain our countries welfare, educational, and judicial system and just keep coming back for more. And after you do all of this you expect us to help you become citizens? Why don't you do something to improve your own country instead of trying to destroy mine.
Ask a lawyer, don't listen to the uninformed opinions of most of these assholes. He can facilitate the application process as a U.S. citizen, but you have to discuss the specifics of your case with an immigration lawyer.
