I am on H1 visa. Can i work a part time job on other company? They are going to issue me a 1099 and not a W2.?

Yes you can work part-time with another company provided they petition you, too. H1 visa only allows you to work legally in the states with the petitioner company but you can have more than 1 temporary work sponsor. A 1099 will show in the ITR you'll file which may be used by USCIS when you decide to extend your H1 or eventually apply for permanent residency. If you can find a part-time job that won't have to issue a w2 or 1099, the better. Caution, though. You might encounter unfriendly co-worker/s that might used it against you.

1. Your second employer will need to file the petition. Or else you can not work.
2. Whether on 1099 or W-2 is a question for CPA to answer.
As long as terms specified in the H1 petition are met (hourly wage/number of hours/actual salary), you are OK.
My understanding is 1099 is for independent contractor and W2 is for employees. Primarily if employer retains control over the employer's output and work schedule, you have to be on W2.
In other words, do everything legally.
NO! If you do you will loose the visa you have from the employer who obtained it for you.
