Immigration - Can they revoke my Green Card??
My question is, will USCIS revoke my greencard? I am a professional male, pay my taxes, no arrests, clean record and i donate spare time to charity (spending time with children with cancer). I have already bought a house and established a life here in this country. Any suggestions or similar experiences like mine?? Will i be able to keep my green card? Let me know! I need to reapply at the end of this year.
Answer:
No.
I hope they send you back to where you came ! Just kidding , they wont man , there about to ligalize millions of people that broke the law , youve been a respectfull american . They wont mess with you !
Three months before your Conditional Green Card expired you should have submitted an application to remove your conditional status. Did you do it? If not you will probably be deported as you are out of status.
You've been here long enough to apply for citizenship... do that or join the military as that is a fast track to permanent legal residency or citizenship.
The first thing you should is consult an immigration attorney. Let him/her do the application for you. Good Luck
Since you were here for 4 years, married for 2 and a half, you will probably not be deported. You will, however, have to go through the USCIS system which can be difficult. If you have been convicted of any crimes, etc. this makes your quest much harder, as it well should. You stated you are clean, and an upstanding citizen.
I would suggest getting an immigration attorney, no matter what anyone tells you. USCIS is overloaded and overworked, so you need someone that knows the system to help better insure you can change your CR status to permanent. Good luck.
As long as you do what is required, you should have no problem. Even if it is conditional, they will look at your status, employment and background. You just reapply and wait and do what you need to do and there should be no problem.
You will not if you can give them a valid reason why you got divorced and make sure they understand yours wasn't a fake marriage.
The form you fill out to file for change of status from 'conditional' to 'permanent', gives you that option.
Think with a clear mind, don't get nervous, be honest and things will work out.
If you had a bad marriage they don't expect you to live in hell just to be able to keep your legal residence. Believe it or not, they're humans also..:-)
.
first you would have to get a divorce then file the form i 751 as entering the marriage in good faith. you would have to prove to the service that the both of you have been in union since your marriage.
if you have enough documents file the form jointly it may be approved w/o a interview. if this is a true marriage you have the documents. if she cheated, she may go with you to the interview, if required, and play the role out of guilt.
You can have the conditions removed 90 days before the 2 year mark if you prove the marriage was in good faith. Having children isn't the only way. Start collecting financial information with both of your names on it like:
Home mortgage/lease/rental agreement
Tax returns
Bank statements
Insurance policies (life insurance that names one of you as the beneficiary for the other's policy).
These are all documents that you would need for marriage based citizenship anyway.
Good luck.
