I am a non Eu National and married a EU member and my immigration status is based on my marriage to him.?
Answer:
It depents on the citizenship of your husband or wife. There is not something like a EU-inmigration law but each member country has its own inmigration laws.
For example, Germany, you must have been married at least two years before you get the so called "eigenständiges Bleiberecht" ( it means something like your own right to stay) . Besides this, there are two more conditions: 1. You and your wife / husband have been living together (under the same roof) and you both have been living in Germany all this time. If you get separated or divorced before this time is due, you loose your right to stay. There is a couple of exceptions in very, very exceptional cases as for example domestic violence, as the german law does not expect that a woman stays two years long together with a man who slaps her.
This information is valid only for Germany, for other countries the law might be different.
